Maint Fee Collection Policy

LAGUNA SPRINGS II MAINTENANCE ASSOCIATION

MAINTENANCE FEE COLLECTION POLICY

Maintenance fees are due on the first day of each quarter, ie January 1, April 1, July 1, and October 1 of each year.  There is a 15 day grace period for payment.

If the quarterly fee has not been paid by the 30 of the month, that is, check received by the bank and posted to the homeowner's account, then a reminder letter is sent to the homeowner by the Management Company and a $25 late fee is added to the homeowner's account.

If payment is not received within the following two weeks (ie, by February 15, May 15, August 15, or November 15 respectively), a demand letter will be sent by the Management Company to the homeowner by certified mail, indicating if payment is not received by the end of the month (ie, February 28, May 30, August 31, November 30), then the account will be turned over to the Association attorney for collection.  If the account goes to the attorney, any attorney fees will be assessed to the homeowner.

If the account goes to the attorney (ie, it is now 60 days overdue), the attorney will send the homeowner a demand letter requesting payment in full of the dues, fines, and associated attorney's fees, within the next 30 days.

If the account remains unpaid at the end of this final 30 day period (ie, March 31, June 30, September 30 or December 31) the attorney will file a claim of lien against the property.
